Understanding the NSW CTP Scheme

CTP insurance is a mandatory policy that every registered vehicle in New South Wales must have. It provides coverage for people injured as a result of the use or operation of a motor vehicle, regardless of whether they were in another car, on a bike or walking at the time.

The scheme is designed to make sure injured people receive prompt support for medical expenses, income loss and rehabilitation without needing to immediately prove fault.

There are, however, two key types of CTP claims:

  1. Statutory Benefits Claims
  2. Common Law Damages Claims

Each serves a different purpose and comes with its own eligibility criteria and entitlements.

1. Statutory Benefits Claims

A statutory benefits claim is the most common and immediate type of CTP claim. It provides short term support to help you recover from your injuries after a motor accident.

You can usually lodge a statutory benefits claim regardless of whether you were at fault, partly at fault or not at fault. The focus is on providing early assistance while the details of the accident are still being investigated.

What You Can Claim Under Statutory Benefits

Through a statutory benefits claim, you may be entitled to:

  • Weekly income payments if you cannot work because of your injuries
  • Medical, hospital and rehabilitation expenses that are reasonable and necessary
  • Domestic and personal care assistance if you need help with daily activities

These benefits generally continue for 52 weeks after your accident. After that time, they can only continue if:

  • Your injuries are classified as non threshold and
  • You were not mostly at fault for the accident.

If your injuries are assessed as threshold or if you were mostly responsible for the accident, your weekly payments and treatment entitlements will end at the one-year mark.

Time Limits

You should lodge your statutory benefits claim within 28 days of the accident to receive back payments from the date of the crash. Claims can still be made up to three months after the accident, but you may lose the right to receive some early benefits.

2. Common Law Damages Claims

If your injuries are more serious and another person was at fault, you may be able to make a common law damages claim. This type of claim provides lump-sum compensation for your long term losses.

Eligibility for Common Law Claims

To make a common law claim, you must meet two conditions:

  1. Your injury must be non threshold, such as a fracture, nerve injury or significant psychological condition.
  2. The accident must have been (fully or partly) someone else’s fault.

These claims are usually made after your injuries have stabilised, so your permanent impairment and loss can be properly assessed. This typically happens 12 months or more after the accident.

What You Can Claim

Under a common law damages claim, you may be entitled to compensation for:

  • Past and future economic loss, including loss of income or earning capacity and includes loss of superannuation benefits.
  • Pain and suffering (if your whole person impairment is more than 10%).

Because these claims are based on fault, gathering strong evidence such as police reports, witness statements and medical opinions is crucial.

Who Can Make a CTP Claim?

Threshold vs Non Threshold Injuries

The distinction between threshold and non threshold injuries determines how long you can receive statutory benefits and whether you qualify for a common law claim.

  • Threshold injuries include soft tissue injuries (like whiplash or muscle strain) or mild psychological issues (like mild anxiety or adjustment disorder).
  • Non Threshold injuries are more serious, such as fractures, nerve injuries, surgeries or diagnosed psychological disorders like PTSD or major depression.
